NO PURCHASE NECESSARY. A purchase will not increase your chances of winning. Eight (8) prizes available, all Deakin gift cards: 1st place $500 CAD, 2nd place $250 CAD, 3rd place $150 CAD, and five (5) runner-up prizes of $50 CAD each. Total approximate retail value: $1,150 CAD. Eight (8) finalists are chosen by a judging panel; their final placing is decided by public vote, and each prize winner must correctly answer a mathematical skill-testing question. Open worldwide to individuals who have reached the age of majority where they live, except where excluded in section 4. Entries close November 30, 2026 at 11:59 p.m. Pacific Time.

Your photo, in plain language

This summary is here to help you understand the rules. If anything in it differs from the formal rules below, the formal rules apply.

•         You keep the copyright. Your photo stays yours. You can keep using it however you like.

•         Deakin gets a broad licence. By entering, you let Deakin and its affiliates use your photo and caption anywhere, forever, for any purpose (website, social media, email, print, packaging, trade shows and ads), and edit or crop it. This applies whether or not you win, and Deakin does not pay you for it beyond any prize. The licence cannot be withdrawn later.

•         We will always credit you. Whenever Deakin publishes your photo, we will credit you by name and the company or school you gave us, plus your social handle if you provided one. If we ever miss a credit by accident, tell us and we will fix it promptly.

•         You confirm it's yours to share. You took the photo yourself, everyone recognisable in it agreed, and you have any permission you need from your employer or the site.

•         Entering doesn't sign you up for marketing. We only send you marketing email if you tick the separate opt-in box.

Formal rules

In these rules, "Deakin", "we" and "us" mean the Sponsor named in section 1, and "you" means the entrant.

1. Sponsor

1.1 The Deakin in the Field Photo Contest (the "Contest") is sponsored and run by [Deakin Industries Ltd. – confirm exact legal name] ("Deakin" or the "Sponsor"), 1361 Powell Street, Vancouver, British Columbia V5L 1G8, Canada. Website: deakin.com. Email: online@deakin.com. Phone: 604-253-2685.

2. Agreeing to these rules

2.1 By submitting an entry or casting a vote, you agree to these Official Contest Rules (the "Rules") and to the decisions of Deakin and its judges, which are final on all matters relating to the Contest.

2.2 Each entry is linked to the version of the Rules in force when it was submitted, shown at the top of this document. If Deakin changes the Rules under section 20, the new version will carry a new version line and date.

3. Contest period and key dates

3.1 All times are Pacific Time (PT). Deakin's server clock is the official timekeeper.

4. Who can enter

4.1 The Contest is open to individuals who, at the time of entry, have reached the age of majority in the province, state, territory or country where they live. In Canada, that is 18 in Alberta, Manitoba, Ontario, Prince Edward Island, Quebec and Saskatchewan, and 19 in British Columbia, New Brunswick, Newfoundland and Labrador, Nova Scotia, the Northwest Territories, Nunavut and Yukon. Elsewhere, it is the age set by local law. Deakin may ask for proof of age.

4.2 Residents of the Province of Quebec are not eligible.

4.3 The Contest is not open to residents of, or individuals located in: Belarus, the Central African Republic, China, the Democratic People's Republic of Korea (North Korea), the Democratic Republic of the Congo, Guatemala, Haiti, Iran, Iraq, Lebanon, Libya, Moldova, Myanmar, Nicaragua, Russia, Somalia, South Sudan, Sri Lanka, Sudan, Syria, Venezuela, Yemen, Zimbabwe, the Russian-occupied regions of Ukraine (including Crimea, Donetsk, Luhansk, Zaporizhzhia and Kherson), Italy and Brazil. Anyone named on a Canadian sanctions list is also ineligible, wherever they live. [Lawyer to confirm the list at launch.]

4.4 The Contest is void where prohibited or restricted by law. You are responsible for making sure that entering is lawful where you live.

4.5 The following people are not eligible: employees and contractors of Deakin and its affiliates; anyone involved in judging or running the Contest; and the immediate family members (spouse or partner, parents, children, siblings, and each of their spouses or partners) and household members of any of them, whether or not related.

5. How to enter

5.1 No purchase is necessary to enter or win.

5.2 To enter, go to deakin.com/pages/photo-contest during the entry period and complete the entry form. You must provide:

1.       your full name, email address, and city/region and country of residence;

2.       the company, organisation or school you want to be credited with (optional; if left blank you will be credited by name only);

3.       your social media handle (optional);

4.       one (1) original photo showing Deakin products in use at a work site, field camp or field school (the "Photo");

5.       the general location where the Photo was taken and a short description or caption (together with the Photo, the "Entry"); and

6.       confirmation that you have read and agree to these Rules.

5.3 One Entry per person for the whole Contest. If you submit more than one, only your first eligible Entry counts. Using multiple identities or email addresses to enter is not allowed and may lead to disqualification of all your Entries.

5.4 The Photo must meet the file requirements on the entry form [format, e.g. JPEG or PNG; maximum size, e.g. 20 MB; minimum resolution, e.g. 2,000 px on the long edge].

5.5 Entries must be submitted by the person who took the Photo. Entries submitted by automated means, scripts or third-party entry services are void.

5.6 An Entry is submitted when Deakin's server receives it. Deakin will send an automated confirmation email; this confirms receipt only, not eligibility.

6. Photo and content rules

6.1 Your Entry must not contain, and Deakin may disqualify any Entry that in its sole discretion contains:

1.       unsafe work practices, or people missing personal protective equipment that would reasonably be required for the activity shown;

2.       offensive, discriminatory, defamatory, violent, obscene or sexually suggestive content, or nudity;

3.       a competitor's brand or products as the main focus;

4.       confidential client or site information, including drill core details, proprietary equipment, site coordinates, or anything that would let a viewer identify a confidential site;

5.       images created or substantially altered with generative AI, or heavily manipulated images (composites, added or removed objects, or added people). Basic edits such as cropping, straightening, exposure, colour, contrast and noise reduction are fine; or

6.       anything that breaks the law or infringes anyone's rights.

6.2 Deakin may also disqualify Entries that break these Rules, are incomplete, are fraudulent, or were submitted by automated means. Deakin may ask for the original, unedited image file at any time to verify an Entry.

6.3 Deakin may moderate, decline to display, or remove any Entry from the Contest page.

7. Finalist judging

7.1 Between December 1 and December 6, 2026, a panel of at least [three (3)] Deakin staff will score all eligible Entries against these criteria:

Criterion

Weight

Use of Deakin gear: how clearly and authentically Deakin products are shown in real field use

[40]%

Photo quality and composition

[25]%

Sense of place: how well the Photo conveys the site, camp or school

[20]%

Storytelling and caption

[15]%

7.2 The eight (8) Entries with the highest total judges' scores become finalists ("Finalists"). If fewer than eight (8) eligible Entries meet a minimum quality standard set by the panel, all such Entries become Finalists. Finalists will be announced on or about December 7, 2026 on the Contest page and notified by email. Every Finalist will win a prize, subject to these Rules.

7.3 Judges' scores are kept on file and used to break ties (section 9.4). They are not published.

8. Public voting

8.1 From December 8, 2026 at 12:00 a.m. PT to January 15, 2027 at 12:00 a.m. PT, anyone may vote for one Finalist on the Contest page. You do not need to be eligible to enter in order to vote, but voting must be lawful where you are.

8.2 To vote, enter your email address and select a Finalist. Your vote counts only after you click the confirmation link sent to that email address. One confirmed vote per email address for the entire voting period. Once confirmed, a vote cannot be changed or withdrawn.

8.3 Vote totals are not published during the voting period.

8.4 Deakin may void any votes, and may disqualify a Finalist, if Deakin reasonably believes votes were purchased, generated by bots, scripts or other automated means, cast using disposable or fake email addresses, or obtained through vote-trading schemes or other fraud. Finalists may share the Contest and ask people to vote, but must not offer anything of value in exchange for votes.

8.5 Voters' email addresses are used only to confirm and validate votes, unless the voter separately opts in to Deakin marketing (see sections 16 and 17).

9. How the winner is selected

9.1 At the close of voting, Deakin will rank the Finalists by the number of confirmed, valid votes each received. The Finalist with the most votes is the potential 1st-place winner, the next is the potential 2nd-place winner, and the next is the potential 3rd-place winner. The remaining five (5) Finalists are the potential runners-up. Together, these are the "potential prize winners".

[Alternative 9.1 – blended score (see Note 2): Each Finalist's final score is 50% their judges' score (scaled to 100) and 50% their share of confirmed, valid votes (scaled to 100, with the Finalist receiving the most votes scoring 100). Finalists are ranked by final score: the top three (3) are the potential 1st-, 2nd- and 3rd-place winners and the remaining five (5) are the potential runners-up.]

9.2 Before being confirmed as a winner, each potential prize winner, including each runner-up, must:

1.       correctly answer, without help of any kind, a time-limited mathematical skill-testing question administered by email, video call or phone, for example: (12 × 4) + 36 ÷ 6 − 9 = ? (correct answer: 45);

2.       sign and return the Winner Declaration and Release (Appendix) within the response period in section 9.5; and

3.       meet all other requirements of these Rules.

9.3 If a potential prize winner cannot be reached, does not respond in time, answers the skill-testing question incorrectly, is found ineligible, or does not return the signed Declaration and Release, they forfeit their prize. Each lower-ranked Finalist then moves up one place (for example, if the potential 1st-place winner forfeits, the 2nd-place Finalist moves to 1st and the 4th-place Finalist moves to 3rd). Any prize left over after all eligible Finalists are placed will not be awarded. No one may win more than one prize.

9.4 Tie-break: if two or more Finalists are tied for any place, the tied Finalist with the higher judges' score from section 7 takes the higher place. If they are still tied, the judging panel will re-score the tied Entries.

9.5 Notification: Deakin will email each potential prize winner within [X] business days after voting closes. Each must reply within [X] days of that email being sent. Deakin is not responsible for messages that go to spam or are not received.

9.6 The 1st-, 2nd- and 3rd-place winners and the five (5) runners-up will be announced together on or about [WINNER ANNOUNCEMENT DATE] on the Contest page and Deakin's social media.

10. Photo rights: ownership and licence

10.1 You keep your copyright. Entering does not transfer ownership of your Photo or caption to Deakin. You remain free to use, license and publish them yourself.

10.2 Licence to Deakin. By submitting an Entry, you grant Deakin and its affiliates a non-exclusive, royalty-free, perpetual, irrevocable, worldwide, transferable and sublicensable licence to use, reproduce, modify, crop, edit, adapt, translate, publish, display, communicate to the public and distribute the Photo and caption, in whole or in part, in any media now known or later developed. This includes Deakin's websites, social media, email, print, catalogues, packaging, trade shows, and advertising and promotion of any kind, for any purpose.

10.3 The licence applies whether or not your Entry becomes a Finalist or wins, and continues after the Contest ends. Sublicensees may include Deakin's agencies, printers, distributors, retail partners and media outlets, each of which must follow Deakin's credit commitment in section 11.

10.4 No payment. You will receive no compensation, fee or royalty for any use of your Photo or caption, other than any prize you win under these Rules.

10.5 No obligation to use. Deakin may choose not to use, display or publish any Entry, and has no obligation to do so.

10.6 Name and details. You also grant Deakin and its affiliates the right to use your name, social handle, company or school, city/region and caption alongside your Photo wherever it is used, without further compensation. If you are a Finalist or win a prize, Deakin may also use your name, city/region, placing, Photo and a statement you approve in announcements and promotion of the Contest, without further compensation, except where the law requires your separate consent.

11. Our credit promise

11.1 Deakin will always credit you. Whenever Deakin publishes your Photo, Deakin will credit you as the photographer, at minimum by your name and the company or school you gave on the entry form, plus your social handle if you provided one. Deakin will use the credit details exactly as you entered them; if you left the company or school field blank, you will be credited by name only.

11.2 The credit may appear in a caption, next to the Photo, or on the image itself, in a way that is reasonable for the medium. Where space is very limited (for example, a small thumbnail or packaging panel), the credit may appear on the nearest practical surface or the linked page.

11.3 Deakin will require its sublicensees to give the same credit.

11.4 If a credit is missed. If Deakin or a sublicensee accidentally omits or gets your credit wrong, email online@deakin.com. Deakin will correct digital uses within [five (5)] business days of notice where it controls them, and will correct printed or fixed materials in the next reprint or production run. An accidental omission or error does not cancel or suspend the licence in section 10, and correction as set out here is your sole remedy for it.

11.5 You can ask Deakin to update your credit details (for example, a new employer or handle) at any time. Deakin will apply the update to new uses and, where practical, to existing digital uses it controls.

12. Moral rights waiver

12.1 Under the Copyright Act (Canada), you have moral rights in your Photo: the right to the integrity of the work and the right to be associated with it as its author. Moral rights cannot be assigned, but they can be waived.

12.2 Subject only to Deakin's credit promise in section 11, you waive, in favour of Deakin, its affiliates, and anyone authorised by them to use the Photo, all moral rights you have in the Photo and caption, to the fullest extent permitted by law. This means, for example, that Deakin may crop, edit, adapt or combine the Photo with other content, and may use it in association with any product, service, cause or institution, without that being a breach of your moral rights. Where the waiver is not permitted by local law, you agree not to assert those rights against Deakin or its licensees.

12.3 This waiver does not affect Deakin's binding obligation to credit you under section 11.

13. Your promises to Deakin and indemnity

13.1 By entering, you represent and warrant that:

1.       you personally took the Photo and wrote the caption, and you own all rights in them;

2.       the Photo is original and has not been entered in, or awarded a prize in, any other contest or promotion run by a competitor of Deakin;

3.       the Photo and caption do not infringe anyone's copyright, trademark, privacy, personality or publicity rights, or any other right, and do not break any law or confidentiality obligation;

4.       every identifiable person in the Photo has consented to its use as described in these Rules, and for anyone under the age of majority, you have the written consent of their parent or legal guardian;

5.       you have any permission needed from your employer, client, and the site or property owner to take and share images of the site and anything shown in it; and

6.       you will provide copies of those consents and permissions to Deakin on request.

13.2 You agree to indemnify and hold harmless Deakin, its affiliates, and their directors, officers, employees and agents from any claims, losses, damages, costs and expenses (including reasonable legal fees) arising from any breach of your promises in section 13.1. Deakin will notify you promptly of any such claim.

14. The prize

14.1 Eight (8) prizes are available, one for each Finalist. Each prize is a Deakin gift card:

Place

Number of prizes

Gift card value (approximate retail value)

1st place

1

$500 CAD

2nd place

1

$250 CAD

3rd place

1

$150 CAD

Runner-up

5

$50 CAD each ($250 CAD total)

Total

8

$1,150 CAD

There is no regional allocation of prizes.

14.2 The prize must be accepted as awarded. It is not transferable and cannot be exchanged for cash, except that Deakin may, at its sole discretion, substitute cash or a prize of equal or greater value.

14.3 Each gift card is redeemable at deakin.com [and at Deakin's Vancouver store], is subject to Deakin's gift card policy at [URL], and does not expire. Gift cards may not be resold.

14.4 Winners outside Canada. Gift cards are issued in Canadian dollars and can be used on Deakin's online store for products Deakin ships to the winner's country. Each winner is responsible for any shipping costs beyond those Deakin normally covers, and for any import duties, taxes, brokerage or customs fees. If Deakin cannot ship to a winner's country, Deakin will work with that winner to arrange a reasonable alternative, which may include a prize of equal value.

14.5 The winner is responsible for any taxes, duties and fees on the prize under the laws where they live, and for any costs not expressly included in the prize.

14.6 Deakin will deliver each prize within [thirty (30)] days after that winner returns the signed Winner Declaration and Release and is confirmed.

15. Chances of winning

15.1 The number of eligible Entries received will affect whether an Entry becomes one of the eight (8) Finalists. Every Finalist who meets the requirements of these Rules wins a prize; which prize they win depends on the confirmed, valid votes they receive compared with the other Finalists [or, if Alternative 9.1 applies: on their judges' score and share of votes]. Finalists who share the Contest more widely may receive more votes.

16. Privacy

16.1 Deakin collects your personal information in line with Canada's Personal Information Protection and Electronic Documents Act and British Columbia's Personal Information Protection Act, and its privacy policy at https://deakin.com/policies/privacy-policy.

16.3 Your information is stored by Deakin and its service providers [name contest platform or host], which may store or process it outside Canada, including in the United States, where it may be accessible to authorities under local law.

16.4 How long we keep it. Information about Finalists and the winner is kept for at least one year after the Contest decision, as BC law requires. Other entry and voting data is deleted or anonymised within [twelve (12)] months after the winner is announced. Your Photo, caption and credit details are kept for as long as Deakin uses the Photo under its licence, so that we can keep crediting you.

16.5 Your choices. To ask for access to or correction of your information, to withdraw from the Contest, or to ask us to delete your information, email online@deakin.com. Deleting your entry information during the Contest withdraws your Entry. Because the licence in section 10 is irrevocable, a deletion request does not require Deakin to remove a Photo it has already published, but Deakin will keep only what it needs to credit you.

17. Marketing emails

17.1 Entering the Contest or voting does not subscribe you to Deakin marketing emails. Deakin will use your email address only for Contest purposes.

17.2 The entry and voting forms include a separate, optional, unticked checkbox to receive Deakin news and offers. Ticking it is not required to enter, vote or win. You can unsubscribe at any time using the link in any marketing email.

18. Release and limitation of liability

18.1 To the fullest extent permitted by law, by entering you release Deakin, its affiliates, and their directors, officers, employees, agents and service providers (the "Released Parties") from any liability for any injury, loss or damage of any kind arising from your participation in the Contest or the acceptance, use or misuse of the prize.

18.2 Nothing in these Rules limits any liability that cannot be limited or excluded by law, or any rights you have under consumer protection laws that cannot be waived.

19. Technical problems

19.1 The Released Parties are not responsible for lost, late, incomplete, misdirected, corrupted or unreadable entries or votes; for failures of computers, networks, servers, software, email or phone systems; or for any error or problem that affects entry, voting or the administration of the Contest.

19.2 Proof of submitting an Entry or vote is not proof that Deakin received it.

20. Changes, suspension and cancellation

20.1 Deakin may modify, suspend or cancel the Contest, or change these Rules, if fraud, technical failure, a virus, tampering or any other cause beyond Deakin's reasonable control affects the fair and proper running of the Contest. Deakin will not make changes that affect the prize, or the way the winner is chosen, unless that is reasonably necessary, and will post any changes on the Contest page with a new version line.

20.2 If the Contest is cancelled, Deakin may, at its discretion, award the prizes based on the Entries and valid votes received up to the time of cancellation, using the method in section 9.

20.3 Deakin may disqualify anyone who tampers with the Contest, breaks these Rules, or acts in a disruptive, abusive or fraudulent way. Any attempt to deliberately damage the Contest or undermine its legitimate operation may be a breach of criminal and civil law, and Deakin reserves the right to seek remedies to the fullest extent permitted by law.

21. Governing law

21.1 The Contest and these Rules are governed by the laws of British Columbia and the federal laws of Canada that apply there. You agree to the exclusive jurisdiction of the courts of British Columbia, except where the law of your place of residence gives you a right to bring a claim locally that cannot be waived.

22. Social media platforms

22.1 The Contest is in no way sponsored, endorsed or administered by, or associated with, Meta Platforms (Facebook, Instagram), LinkedIn, X or any other social media platform used to promote it. By entering, you release those platforms from any liability relating to the Contest. Questions about the Contest should go to Deakin, not to the platforms.

23. Questions and the winner's name

23.1 Questions about the Contest: email online@deakin.com or call 604-253-2685.

23.2 To get the first names, last initials, cities/regions and placings of the prize winners after the Contest, email online@deakin.com with the subject line "Photo Contest Winners" within [ninety (90)] days after the winners are announced. The winners will also be announced on the Contest page.

24. Order of precedence

24.1 If there is any conflict between these Rules and any Contest advertising, the Contest page summary or the plain-language summary above, these Rules govern.

(a) Items for the lawyer to review

The two highest-priority items are the winner-selection method (item 2) and the photo licence's enforceability abroad (item 6).

1.       Legal entity. Confirm the Sponsor's exact incorporated name and registered address.

2.       Public vote and Competition Act s. 74.06(c). Whether a popularity vote counts as selection "on the basis of skill", or whether to use the blended-score alternative in section 9.1 or judges' confirmation.

3.       Skill-testing question. Whether it is needed for this judged-plus-vote structure, and whether the sample question and method of administering it are adequate.

4.       Quebec. Quebec is excluded (section 4.2). Confirm the exclusion wording is sufficient, and that the contest page and promotion are not directed at Quebec in a way that would trigger French-language requirements.

5.       Excluded countries. Whether to narrow the sanctions list in section 4.3 to comprehensively sanctioned jurisdictions, and whether to add other countries (Belgium, Sweden, India, Mexico, Spain, Portugal, Hong Kong, Philippines, Colombia) or local-language requirements (France, Germany, Spain).

6.       Photo licence. Enforceability of a perpetual, irrevocable, sublicensable licence accepted through an online form, especially against consumers in other countries (e.g. EU unfair-terms rules). Consider whether the online acceptance is clear enough (e.g. an unticked "I agree" box and storing the Rules version with each entry).

7.       Moral rights waiver. Whether the waiver in section 12 sits correctly alongside the credit promise, and how it operates where local law does not permit waiver.

8.       Credit promise remedy. Whether making correction the sole remedy for a missed credit (section 11.4) is enforceable and sufficient.

9.       Third-party consents. Whether Deakin should require signed model releases for identifiable people (especially minors at field schools) before publishing, rather than relying on the entrant's warranty.

10.   Confidential site content. Whether to add a review step before publishing to catch client-confidential details.

11.   Indemnity and release. Enforceability against consumers in BC and abroad; carve-outs for non-waivable consumer rights.

12.   Privacy. Retention periods, cross-border storage disclosure for the chosen contest platform, and whether any EU/UK entrants trigger GDPR obligations.

13.   CASL. That the opt-in checkbox wording, sender identification and unsubscribe mechanism meet CASL's express-consent requirements.

14.   Gift card. That Deakin's gift card policy has no expiry or dormancy fees, and the approach to winners Deakin cannot ship to.

15.   Tax. Any withholding or reporting obligations if the winner is in the US or elsewhere (US reporting applies to prizes of $2,000 USD or more from 2026, so each prize here, at $500 or less, is likely below it).

16.   Governing law and jurisdiction clause for an international entrant base.

(b) Appendix: Winner Declaration and Release

Deakin in the Field Photo Contest – Winner Declaration and Release Rules version: 2026-11-v1

To: [Deakin Industries Ltd. – confirm legal name] ("Deakin"), 1361 Powell Street, Vancouver, BC V5L 1G8

I, the undersigned, have been selected as a potential prize winner of the Deakin in the Field Photo Contest (the "Contest"), placing [1st / 2nd / 3rd / runner-up]. In order to receive my prize, a Deakin gift card of [$500 / $250 / $150 / $50] CAD, I declare and agree as follows:

1.       Eligibility. I have reached the age of majority where I live. I live in an eligible jurisdiction under section 4 of the Official Contest Rules (the "Rules"). I am not an employee or contractor of Deakin or its affiliates, involved in running or judging the Contest, or an immediate family or household member of any such person.

2.       Rules. I have read the Rules and complied with them. I answered the skill-testing question correctly and without help.

3.       My photo. I personally took the photo I entered (the "Photo") and wrote its caption. Every promise I made in section 13 of the Rules is true, including that I have consent from every identifiable person in the Photo (and from a parent or guardian for any minor) and any permission needed from my employer or the site owner.

4.       Photo rights. I confirm the licence I granted Deakin in section 10 of the Rules, my waiver of moral rights in section 12, and my agreement to the use of my name and details in section 10.6. I understand that I keep my copyright and that Deakin has promised to credit me as set out in section 11.

5.       Publicity. I agree that Deakin may announce me as the winner and use my name, city/region, Photo and an approved statement to promote the Contest, without further compensation, except where the law requires separate consent.

6.       Prize. I accept the prize as awarded. I understand it is not transferable and I am responsible for any taxes, duties, shipping or other costs not expressly included.

7.       Release. To the fullest extent permitted by law, I release Deakin, its affiliates, and their directors, officers, employees, agents and service providers from any liability for any injury, loss or damage of any kind arising from my participation in the Contest or my acceptance, use or misuse of the prize. Nothing here waives rights that cannot be waived by law.

8.       Indemnity. I agree to indemnify Deakin as set out in section 13.2 of the Rules if any of my declarations above are untrue.

9.       Forfeit. I understand that if any statement in this declaration is untrue, I will forfeit the prize and may be required to return it or its value.
